PALM BEACH, Fla.—It’s a common employer tactic – trying to stuff a proposed bargaining unit with anti-union workers before the election. But Steven Cohen, the National Labor Relations Board’s southern Florida acting regional director, didn’t buy it.

On Dec. 20, he gave the go-ahead for a representation election among 60 shipside stevedores at Tropical Shipping USA in Palm Beach.

They’ll vote on whether they want International Longshoremen’s Association Local 1359 to represent them. Tropical tried to stuff the unit with 226 other workers, including warehouse workers and secretaries, arguing they all had a “community of interest” with the stevedores. Cohen turned that idea down.
