Industrial unions skeptical about Trump’s ‘new NAFTA’ negotiating objectives

WASHINGTON—Leaders of major industrial unions, and their allies in the war against job-losing so-called “free trade” treaties, reacted skeptically to Trump administration negotiating objectives for a “new NAFTA.”

They said the objectives contain pro-corporate provisions lifted wholesale from the now-dead Trans-Pacific Partnership “free trade” pact, which unions, their allies and congressional Democrats forced the Obama administration to dump last year. And the objectives are weak in other areas, the leaders added.

“Any trade agreement without the ability to increase the standard of living for Mexican workers” so that corporate exploitation of them would not cost U.S. jobs “will not fix NAFTA,” Auto Workers President Dennis Williams warned in a July 20 telephone press conference.

U.S. Trade Representative Robert Lighthizer, known for past skepticism towards free trade pacts, released the objectives on July 17, so talks with Mexico and Canada on a “new NAFTA” can actually start in two months or so.

Lighthizer emphasized the new NAFTA’s presumed benefits to business, but his 17-page negotiating objectives document also includes several labor goals. Among them are:

• Writing worker rights into the texts of trade pacts.

• Requiring the U.S., Canada and Mexico to follow some internationally recognized “core labor standards,” including freedom of association and collective bargaining, and

• Killing the pro-business trade court, called the Investor State Dispute System.

Other labor goals are notably absent. One omission: A strong domestic content requirement — a specific percentage of U.S.-made goods — for cars and trucks, which UAW demands. Another: Barring unsafe Mexican trucks and unqualified Mexican drivers from roaming all U.S. roads, endangering U.S. truckers and safety, which the Teamsters fight for.

Lighthizer said the objectives included decisions based on three days of public hearings – where the Teamsters, the Machinists, the AFL-CIO and the Auto Workers interrupted a constant stream of corporate witnesses – and 14,000 written comments.

Lighthizer’s introduction said the new NAFTA would help farmers, ranchers, service providers and other businesses grow exports. He did not mention workers or their rights. “Most importantly, the new NAFTA will promote a market system that functions more efficiently, leading to reciprocal and balanced trade among the parties,” he says.

That pro-corporate tilt prompted criticism from Steelworkers President Leo Gerard, Machinists President Bob Martinez, Lori Wallach, executive director of Public Citizen’s Trade Watch – who is an experienced trade attorney – and other worker allies.

“The USTR seems to be backing the same priorities that have guided trade agreements since NAFTA was first negotiated, promoting corporate interests and leaving workers behind,” Gerard said.

“This is not what workers who supported President Trump in the election expected: They assumed that he would renegotiate NAFTA to create better paying jobs for them and their families, rather than chasing higher profits and greater protections for corporate interests.”

“Any renegotiation that starts off with the current trade template found in TPP is unacceptable,” Martinez stated. “Labor provisions, rules of origin and many other provisions in TPP fall far short of the substantive changes that need to be made for trade agreements to begin benefiting working families.

“These provisions must be changed so multinational corporations cannot continue to profit from the advantages of a trade agreement while workers suffer stagnated wages and economic insecurity” while companies move U.S. factory jobs “to countries that do not respect fundamental human rights,” he declared.

“In a blunt display of hypocrisy, Donald Trump appears to want to copy and paste the weak labor and environmental provisions of the TPP, a deal that Trump claimed to hate,” said Michael Brune, executive director of the Sierra Club. His organization and the Steelworkers co-founded and still lead the BlueGreen Alliance of unions and environmental groups.

“Based on today’s ‘plan,’ one could be forgiven for concluding that Trump’s opposition to the TPP was merely political theater and this administration has no intent of fundamentally changing NAFTA,” Brune added.

Wallach got into the details of the administration’s objectives, after criticizing it overall. She also predicted that with objectives like this, the new NAFTA would go down the drain on Capitol Hill, even under “fast-track” voting which allows only one up-or-down vote in each house of Congress, and no changes in the text of a new NAFTA or the law implementing it.

“This document does not describe the promised transformation of NAFTA to prioritize working people that some voters were expecting based on President Trump’s campaign pledges,” Wallach said.

“More than 910,000 specific American jobs have been certified as lost to NAFTA under just one narrow program, but this document does not make clear whether NAFTA’s job offshoring incentives or its ban on Buy American procurement policy will be eliminated or labor or environmental standards better” than in the Trans-Pacific Pact.

“The document is quite vague so while negotiations can start in 30 days, it’s unclear what will be demanded on key issues, whether improvements for working people could be in the offing or whether the worst aspects of the TPP will be added making NAFTA yet more damaging for working people,” she concluded.
